Workers Comp Claim Process: Second Opinion from Independent Doctor

If your claim has been accepted, you may be forced to see the doctor your employer chose for you for the duration of your treatment. However, if you have received weekly workers compensation income benefits, you may have the right to an independent examination with the physician of your choosing at the insurance company’s expense. Georgia law provides that you may be seen for a one-time evaluation by the physician of your choosing (within 50 miles from your home), as long as you make the request to the insurance company within 120 days from the last time you received workers compensation income benefits.

The process can be confusing, given all of the requirements and time limits. You may have questions about whether your workplace injury claim has been accepted, or whether Georgia law requires you to be examined by the doctor chosen by your employer. An experienced Georgia workers compensation attorney can guide you through the process and help you make the best decisions in your case.

Don’t wait until it is too late to choose the work injury doctor you are comfortable with, contact The Law Offices of T. Andrew Miller today!
